Bury Parish Council wishes to object to this application. 

It is persuaded by the arguments put forward and expressed in the Landscape Planning Advice provided by Environmental Initiatives of Hampshire County Council and the reasons for its objection are as follows.

1. The proposal is a change of use from agricultural to residential/business.

2. The site occupies an elevated and prominent position at the heart of a rural area of pastures and woodlands. It is visible from several directions and is located only 350m from the West Burton conservation area.

3. This proposal is in a rural location, outside the settlement boundary, and is contrary to the character of the area.

4. Though the 1960s barns are of no architectural value, their conversion would be contrary to conserving the historic settlement type of small, nucleated villages – a stated aim of the SDILA.

5. It is contrary to BPC’s NDP objective no. 2 – to enhance the rural feel and character of the Parish, preserving our agricultural and built heritage wherever possible.

6. It is also contrary to the NDP’s 5th objective – to conserve and enhance the natural beauty, wildlife, and cultural heritage of the Parish within the National Park.

7. The site is not included in BPC’s NDP as a location for future housing development within the parish.

8. BPC’s NDP also notes that while certain parts of the Parish have had development in modern (post 1940s) styles, this is not a reason to allow further inappropriate development within it.

9. BPC’s NDP Policy 2 states: All development should respond to the rich built heritage of the Parish and character of the area in which they sit … This should be achieved by Incorporating similar architectural features into the design as those that are found in traditional buildings in the village … and External materials should reflect the palette of materials found in traditional buildings within the Parish.

10. BPC is not persuaded that the proposals follow a landscape led approach respecting the agricultural nature of the area. This proposal will contribute to the erosion of the intrinsic sense of remoteness.

11. The inclusion of business premises within the proposal sets a precedent for further business unit expansion. 

12. The large-scale use of glazing on the west and east elevations of the main barn would introduce unacceptable visual intrusion into the landscape.

13. The existing footpath 758/1 runs through the site. The application shows no proposals for safeguarding this path.

14. The proposed extent of hard surfacing would be out of character with the area.

15. The proposal should require a statement on contamination from the deterioration of asbestos cladding and roofing from a past fire at the site. 

16. BPC is concerned at the precedent such a permission could set. If this proposal is approved, any such barn could refer to this application as justification for conversion. 

Notwithstanding Bury Parish Council’s objections, it would nevertheless welcome proposals to visually improve the state of the farm. It does not rule out development completely and considers an application that incorporated the objections laid out above could potentially fund favour.

BPC Decision: ‘At first glance, this application for three Velux roof lights to light the attic space of a recently completed garage building would seem to be a minor issue. On closer inspection, however, it is considered that a successful application for these three roof lights will set a dangerous precedent to the continued careful management of the conservation area.

No size or model number is given in the application but a scale bar is provided on the drawings. The width is almost a metre and, from the Velux catalogue, there is a range of units that are all 94cms wide. The heights vary from 55cms to 140cms and it appears the proposal is for either the 98cm height or the 118cms height. That will produce around 1 sq m of unbroken glass for each roof light. Given the requirement to illuminate a relatively small area, this amount of glass would seem an exaggerated response to the need.

The issue is therefore both the size of the proposed Velux units and the number of them. Bury Parish Council carefully considered the application and concluded that is should object on the basis of the following six grounds.

Design – the specification of three 94cm x 98cm roof light is inappropriate to the visual context of the conservation area and would therefore be in contravention of BNDP policy 4 (built character) and policy 4 of the South Downs Local Plan. Smaller ‘conservation’ roof lights detailed so that to be set into the clay tiled roof would be far more appropriate to the context.

Number – a single such conservation roof light would not only better protect the conservation area, it would satisfy any reasonable ventilation and daylight requirement. It should be set high in the roof space (as 2 of the proposed roof lights are described).

Reflection – a large roof light placed on each of the south, east and west roof slopes will cause unwanted reflections on sunny days. A single roof light of this size would cause a problem of unwanted reflection but three, each placed in different aspects, would seem guaranteed to cause such a visual nuisance.

Dark skies – the applicant dismisses the issue of light pollution by specifying Velux units with integral blackout blinds. The difficulty with this is that there is neither compulsion nor guarantee that they will be closed at night. The most effective way of protecting the National Park’s dark skies policy is not to have roof lights in the first place. The approval of three large roof lights providing far more daylight than could possibly be required seems an unnecessary risk to our dark skies and therefore contravenes policies SD8 and BNDP 15.

Sustainability – facing south, west and east, three such roof lights will cause a considerable level of overheating. The new clauses of the building regulations (Approved Document 0) are specifically drawn up to prevent this and it would seem strange if a planning authority was to grant approval for something that is so very much at odds with current thinking on comfort and sustainability.

Precedent – if this application in the heart of Bury’s conservation area is approved, then why would any other applicant not feel justified in making similar applications? If roof space is at a premium, there will be pressure to occupy it and make it more valuable with the installation of such roof lights. The prospect of this brings with it a real threat to the character of the conservation area.

In making its objection, Bury Parish Council recommends that this application is resubmitted with a single small conservation roof light placed in the roof slope that looks towards the applicant’s garden.’

BPC Decision: The Council objects to this application as the external wall rendering is contrary to Bury Neighbourhood Plan Policy 2 – Built Character:

  2. Concrete blocks
  3. Plain brick elevations”

Rendering is not specifically mentioned but the list is not exhaustive so we urge the applicant to consider an alternative cladding such as timber boarding which would be more in keeping with the architectural character of the village.

The Council has no objection to the extension and roof alterations but would also like to see the issue of light pollution given further consideration either through a reduction in glazing or the use of a type of ‘smart’ glass in order to comply with BNDP policy 15 and SD8 of the SDNPA Local Plan Dark Night Skies.

If this was to fail, it would result in it appearing as a  prominent and intrusive feature within a street scene where historic and traditional buildings prevail and, as a result, it would cause considerable harm to the character and appearance of this attractive village setting.

The council does not object to the principle of erecting an office in the garden but urges the applicant to reconsider the location.

Bury Parish Council duly considered application SDNP/21/06305/HOUS for Ferry Cottage at its meeting on the 21st February 2022. It considered that the proposal would cause harm to a listed building in the village’s conservation area and it was minded to object with reference to policy SD12 as it would not safeguard the village’s heritage assets and setting.

Specifically, the Council felt that the proposal was out of character with its host building and that the simplicity and balanced charm of its garden elevation would be lost. The flat roof caused some difficulty, the rooflight is at odds with the SDNP Dark Skies policy and the brick boundary wall lacked detail in terms of ‘brick bond’ and, it was thought, might be better handled with a more subordinate material such as painted boarding.

BPC was critical of the Design and Access and Heritage statements in making unsupportable claims about the lack of harm to a historic structure and in not drawing attention to the material fact of a previously approved application which will expire in August of this year. Despite being a more modest proposal, BPC was surprised this earlier proposal had been approved as it related to the listed building in the same manner as the current proposal.

That said, the earlier approval is a material consideration and though BPC could certainly not support this application, it chooses to remain neutral on the matter.

In the view of BPC, this project should be considered as still in a design development stage, and we would ask that is be withdrawn for further discussion. Parish Council Decision: Hollow Farm is significant for two reasons. It is a Grade II listed building and it is also the first building to be seen when arriving into the village from its northern end. The close proximity of the proposal to the original farmhouse makes it a part of the composition of a group of which the listed building should be the dominant structure. The application is for an amendment to the previously approved proposal which achieved that compositional role more successfully than this amendment.

There is no issue with the principle of demolishing the existing garages, retaining the plant room element and rebuilding and extending the existing space as shown in the proposed plans. Had this proposal shown this new footprint under a simple clay tiled hipped roof (more in the manner of the approved scheme), it is likely it would have received renewed support.
The issue raised by this new application is the gabled elevation. The relationship of the proposed two storey gable to the listed farmhouse seems arbitrary and out of scale. This is a proposal in which the wall rather than the roof is now dominant and it is that coupled with its proximity to the listed building which creates a sense of competitive discomfort.
The hipped composition of the approved scheme is very much more preferable to the new proposal and the Parish Council urges the applicant to reconsider this strategy so that it could be in a position to support it. It would welcome an amendment to the roof form and it would encourage the simplest possible shaping of a hipped roof that signals an agricultural structure subordinate to the farmhouse but confident in its role in the group
